1. your contract

1.1 – Please read the following Terms and Conditions carefully.  By signing the accompanying Booking Form, you agree to be bound by the Terms and Conditions

1.2 – Once signed, the Booking Form (together with these Terms and Conditions) acts as a contract between you and Oman sail Charter and confirms your booking with Oman sail Charter, subject to full payment.

1.3 -You agree to provide correct information to the best of your knowledge on the Booking Form, including the requested medical information for members of your party, which may be important for Oman Sail Charter and the Skipper to be aware of for your safety.

2. Price / Payment

2.1 Once booked, the agreed price of your booking is fully guaranteed by Oman sail Charter and will not be subject to any surcharge provided you meet the payment schedule.  (However the price may be adjusted to correct invoice errors or to company with any new Government mandate charges.)

2.2 A deposit of 25% of your booking price (minimum 50 OMR) is payable at the time of booking to reserve the date and vessel of your charter. 

2.3 Full payment of the balance of your booking is required a minimum of 4 weeks before your charter date.  Full payment together with a completed Booking Form confirm your booking.

2.4 If any payment due is not received in full and on time, we reserve the right to treat your booking as cancelled by you. 

3. Cancellations

3.1 You may cancel your booking at any time. Written notification of cancellation must be received from and confirmed in writing by Oman Sail Charter.

3.2 If you cancel your booking with less than 2 weeks’ notice before your charter date, you will forfeit all amounts you have paid towards your booking.  In cases of emergency, Oman sail Charter may at its sole discretion waive or reduce such forfeiture.

3.3 If you postpone or alter your booking with less than 2 weeks’ notice before your charter date, you will forfeit your deposit as an administrative charge, but the other payments you have made will be credited to your new booking.  If you postpone or alter your booking with more than 2 weeks’ notice before your charter date, then all payments you have made (including deposit) will be credited to your new booking.

3.4 Your payment credit from postponed bookings can be held with Oman Sail Charter for a maximum period of 12 months from the date that we received and confirmed your notice of postponement.  You will forfeit any payment credit that you do not use during this 12-month period.

3.5 Oman sail Charter reserves the right to cancel, postpone  or alter your booking due to circumstances outside of our control, at our discretion.  The most common such circumstance is bad weather. As much notice as possible will be provided, however this can be as last minute as a few hours before departure.  In the event of such cancellations, postponements or alterations, Oman sail Charter are not obliged to issue refunds or compensation to you, but we will do our best to re-organise and limit inconvenience to you.

4. Restrictions

4.1 Oman Sail Charter and its staff are responsible for the safe conduct of your charter and activities and may vary your itinerary for safety purposes.  Oman Sail Charter staff in their sole discretion shall decide whether or not the conditions are safe to use a particular craft.

4.2 It is not permitted for any Oman Sail Charter craft to do night sailing or participate in any third party race without the presence of an Oman Sail Charter employed Skipper, or written consent from the company.

4.3 The vessel must, at all times, stay within the Oman Sail Charter cruising limits.  These limits have been put in place with your and your party’s safety as well as the safety of the Skipper, in mind.

4.4  All passengers shall be names on the Booking Form, and no other passengers shall be permitted on the vessel.

4.5  A life jacket will be provided for each authorized passenger.  Life jackets should be worn as appropriate.

5. Liability

5.1 Boating inherently involves risks of physical danger and also may not be suitable to participants with certain health conditions and needs. You and each member of your party are responsible for ensuring your physical fitness is satisfactory to participate.

5.2 Oman Sail Charter is Not liable or responsible for death or personal injury, loss or damage to personal property, suffered by you or any member of your party, or any third party, nor for any losses resulting from such incidents, unless  directly caused by the proven negligence of Oman Sail Charter staff as decided by the Omani courts.

5.3 Oman Sail Charter is NOT liable or responsible for death, or personal injury, loss or damage to personal property, suffered by you, any member of your party, or any third party, nor for any losses resulting from such incidents, caused by an activity outside of the activities permitted by Oman Sail Charter.

5.4 Oman Sail Charter shall insure the vessels and their equipment against fire, marine and collision risks with third party damage cover of not less than 2,000,000 GBP.

5.5  Any complaints must be notified to Oman Sail Charter in writing.

6. Equipment / Activities

6.1 All the Powerboats and Sailing vessels used by Oman Sail Charter are of international standards and regulations and maintained regularly by qualified sub-contractors.

6.2 For staffed vessels, the Oman Sail Charter member(s) of staff is responsible for the safety of all members on board the vessel.  Therefore you will ensure co-operation of all of your party on board the vessel.

7. Images

7.1 From time to time authorised parties may carry out photography and/or video recording. You agree that we may use such images as promotional advertising or publicity material in any format whatsoever. You further agree that copyright rests with such authorised parties unless otherwise agreed.

8. Force Majeure

8.1 Oman Sail Charter reserves the right to cancel, postpone or alter your booking due to circumstances outside of our control, at our sole discretion, for circumstances amounting to force majeure. The most common force majeure circumstance is bad weather, but force majeure may also include, without limitation: war, riots, government action, terrorism, fire, strike action and all similar events outside of Oman Sail Charter’s control.

8.2 As much notice as possible will be provided for cancellations, postponements or alterations due to force majeure, however this can be as last minute as a few hours before departure.

8.3 In the event of cancellations, postponements or alterations due to force majeure, Oman Sail Charter is not obliged to issue refunds or compensation to you but we will do our best to re-organise and limit inconvenience to you.

9. Governing Law

9.1 The Booking Form and these Terms and Conditions are subject to the laws of the Sultanate of Oman.
